End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User," "you," or "your") and ProcessFlow, Inc. ("Company," "we," "our," or "us") for the Lume mobile application ("App"), which includes computer software and may include associated media, printed materials, and online or electronic documentation.

By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices that you own or control
• Access and use the App for your personal, non-commercial use
• Receive updates and upgrades to the App that we may provide

3. License Restrictions

You agree NOT to:

• Copy, modify, adapt, translate, or create derivative works based on the App
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Use the App for any commercial purpose without our express written consent
• Use the App in any way that violates applicable laws or regulations
• Interfere with or disrupt the App or servers connected to the App
• Attempt to gain unauthorized access to any portion of the App

4. Third-Party App Store Terms

4.1 Apple App Store

If you download the App from the Apple App Store, you acknowledge and agree that:

• This EULA is between you and ProcessFlow, Inc., not Apple
• Apple has no obligation to furnish maintenance and support services
• Apple is not responsible for addressing any claims relating to the App or your use of it
• Apple is a third-party beneficiary of this EULA and may enforce this EULA against you
• You must comply with Apple's Terms of Service and App Store Review Guidelines

4.2 Google Play Store

If you download the App from Google Play, you acknowledge and agree that:

• This EULA is between you and ProcessFlow, Inc., not Google
• Google is not responsible for the App or its content
• You must comply with Google's Terms of Service and Developer Distribution Agreement

5. Intellectual Property Rights

The App and all rights, title, and interest in and to the App (including all intellectual property rights) are and will remain the exclusive property of ProcessFlow, Inc. and its licensors.

The Lume name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ProcessFlow, Inc. or its affiliates or licensors. You must not use such marks without our prior written permission.

6. User Data and Privacy

Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and disclose information about you.

You retain all rights to the content you create, post, or share through the App ("User Content"). By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content solely for the purpose of providing and improving the App.

7. Subscriptions and Payments

7.1 Subscription Plans

The App offers both free and premium subscription features. Subscription pricing and features are subject to change with notice.

7.2 Payment Processing

Payments are processed through:

• Apple In-App Purchase for iOS users (subject to Apple's terms)
• Google Play Billing for Android users (subject to Google's terms)

7.3 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You will be charged through your App Store account.

7.4 Cancellation

You can cancel your subscription at any time through:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play Store > Menu > Subscriptions

7.5 Refund Policy

Refunds are handled by Apple or Google according to their respective policies. We do not process refunds directly. Contact Apple or Google customer support for refund requests.

8. Updates and Modifications

We may update, modify, or discontinue the App or any features at any time without notice. Updates may be:

• Automatically downloaded and installed on your device
• Required to continue using the App
• Provided to improve functionality, fix bugs, or enhance security

By using the App, you consent to automatic updates.

You agree to indemnify, defend, and hold harmless ProcessFlow, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising from your use of the App, violation of this EULA, or violation of any rights of another party.

12. Termination

This EULA is effective until terminated. We may terminate this EULA at any time if you:

• Breach any provision of this EULA
• Violate applicable laws or regulations
• Engage in conduct harmful to other users or the App

Upon termination, you must immediately cease all use of the App and delete all copies from your devices. Sections that by their nature should survive termination will remain in effect.

13. Governing Law and Dispute Resolution

This EULA is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from this EULA or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, or in small claims court if eligible.

14. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes become effective constitutes acceptance of the modified EULA.
